Smash Studios Policies – New York

 

  1. Deposit & Payment Requirement:

 

(a). For Stages, Stage Suites, Showcase Suites, Recording, Video Production, Production Studios, Podcast Studios, and/or Stages/Performances/Showcases/Venue– Deposit of 50% to book session, Balance Due 1 Week Prior to booked session.  If balance cannot be charged, session will be cancelled, and deposit will be considered used and non-refundable.  

 

(b). For Standard & Elite Performance/Rehearsal Bookings –Deposit of 50% to book session, Balance Due 48 Hours Prior to booked session.  If balance cannot be charged, session will be cancelled, and deposit will be considered used and non-refundable.  

 

(c)  For Standard & Elite Rehearsal Sessions of 4 hours or more —Deposit of 50% to book session, Balance Due 48 Hours Prior to booked session.  If balance cannot be charged, session will be considered used and non-refundable.  


  1. ALL DEPOSITS AND PAYMENTS ARE NON-REFUNDABLEand can be used towards your session that you book or for a session in the future. If you cancel within the proper guidelines stated below you may use your payment and/or deposit for a future session.  Late payments will incur late fees.

Please note, that if you would like to use your deposit towards your session you must tell the manager on duty upon completion of your session. Otherwise, your deposit will be kept as a floating deposit for a future session automatically.


  1. 3. Performances/Rehearsal/Showcase Cancellations And/Or Changes Policy: One Day’s Notice Is Required For Every Hour Booked. (Example: 4 Hour Booking = 4 Days Advance Notice To Smash). Lockout bookings require at least 30 day’s notice for cancellation and/or changes. IF YOU DO NOT CANCEL WITH PROPER NOTICE YOU OWE FOR THE ENTIRE SESSION AND WILL BE CHARGED ACCORDINGLY. 

  2. Recording, Video Production, and Podcast CancellationsAnd/Or Changes Policy: 1 Week’s Notice Required. IF YOU DO NOT CANCEL WITH PROPER NOTICE YOU OWE FOR THE ENTIRE SESSION AND WILL BE CHARGED ACCORDINGLY.

  3. Recording, Video Production, and Podcast CancellationsSessions Booked Within The Same Week Are Not Eligible For Cancellation Or Changes.

  4. Snow Storm Cancellation Policy:If Mass Transit Is Suspended, Customers Can Reschedule Their Booking, But Not Cancel. Once The Rescheduling Is Made, No Further Changes Can Occur.

  5. Clients Are Responsible for Checking and Reading Their Confirmation Emails And Inform Smash Studios Of Any Discrepancies Immediately they may find in the email confirmation.

  6. Studio Rentals Do Not Include: Guitars, Acoustic Pianos, Congas, Additional Microphones, ¼ “ Cable, Additional Keyboards, And Other Items Not Already In Place in the Studio Booked.  All Are Available For Hourly and Daily Rental, Please Ask Manager On Duty for Information.

  7. Studios Are Pre-Set (to a standard basic generic set up, not to the specific requirements of clients) with Backline that come with that Particular Studio. We Are Not Able To Move Gear From Studio to Studio.

  8. Any Repairs Or Replacement Of Equipment Damaged Due To Client Negligence Will Be The Sole Responsibility Of The Client.

  9. Large Groups, Parties, And Events Will Have A Surcharge Of At Least 1 Additional Hour For Clean Up At The Studio’s Discretion. Showcase Suites with parties of 20 or more are all assessed a $250 Surcharge.

  10. Additional Charges May Apply For The Following: • Tampering Or Changing Sound System Settings • Trash Left In Rooms • Gear Moved From Original Set Position • Other Issues That May Arise Determined By The Studio

  11. If Clients Move Any Gear within a studio (Including Drum Hardware And Cymbals) it Must Be Returned To Original Set Up Or Charges Will Be Incurred. 

  12. Unauthorized Removal Of Smash Studio Property Will Be Prosecuted To The Full Extent Of The Law.

  13. NO SMOKING ANYWHEREOn Premises As Required By The New York City Fire Department.

 

  1. Customer understands that Smash Studios will provide the equipment listed for each individual studio on www.smashstudios.com. Customer understands that equipment within the studio may need repair and Smash will substitute broken equipment with something similar.  Customer understands that equipment from different studios cannot be moved.

 

  1. Smash Studios is not responsible for lost or stolen property other than that that which is owned by Smash Studios.

 

  1. Smash Studios is not responsible for any property broken on or off Smash Studio premises other than that which is owned by Smash Studios.  

 

  1. Smash Studios is not responsible for any equipment or instruments that are not the property of Smash Studios.  In the event that a customer has issues with their equipment, it is not the responsibility of Smash Studios to offer credit or refunds due to any delays or issues caused by that equipment. Smash Studio is not responsible for setting up equipment or instruments brought in by the customer, but “may” do so if time permits.  

 

  1. Please note that Smash Studios works on a tiered approach to all studios.  Standard Studios, for example, do not include extensive technical set up by Smash Studios Staff.  Elite and Showcase Studios will be attended to by Smash Studios Staff as first priority.    

 

  1. Smash Studios is not responsible or liable for any injuries to customers and/or their guests, nor for the loss or damage to customer’s equipment or any other loss or damage to the property of customers and/or their guests, that may take place or occur at/on Smash Studios premises. 

 

  1. Location Fee and Authorization Filming or videotaping of any kind at Smash Studios is strictly forbidden without written authorization by Smash Studios Management.  Upon acceptance of any filming, a location fee of $250 will be charged. 

 

  1. All Performance and/or Production Set Up Time is Part of the Session Time Booked and Charged.  There is NO Free Pre-Set Up For Performances, Recording, Video Production, Podcasts, Showcase or Rehearsal Sessions.  

 

  1. Jurisdiction:  This agreement shall be governed by the laws of the State of New York.  Any controversy or claim arising out of or relating to this agreement shall be resolved by arbitration by a single arbitrator in the City of New York, in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered may be entered in any court having jurisdiction thereof.

 

  1. For Audio and Video Production services:  Smash Studios sole responsibility for any audio and/or video recording services shall be to produce technically satisfactory recordings.   Smash Studios assumes no responsibility for the quality of the performances embodied in the recordings, nor of the commercial viability of any such recording.  Provided the recordings are technically satisfactory, you waive any claims as to your satisfaction with the final product.

 

  1. Load in and load out of equipment is available via our commercial service elevator from 8:30pm to 4pm Monday to Friday at no additional charge.  Load in or out of equipment via commercial elevators at any other time does incur additional charges.  Please contact studio in advance of your session for arrangements regarding load in and load out of equipment.

 

  1. Storage of road cases, equipment, etc. belonging to or rented by clients must be kept within the studio or space they have rented.  Storage is not allowed in the hallways or common areas of Smash Studios.  If additional storage is needed outside of booked Smash Studios space, additional charges will apply.  

 

  1. Provisions being taken by Smash Studios during and thereafter the 2020 Covid 19 Pandemic customers must be fully responsible for their own safety and health.  With full knowledge of the risks involved clients hereby release, hold harmless, and indemnify Smash Studios and its employees for any claims due to possible sickness. You hereby waive any, and all COVID-19 related claims against Smash Studios
